END USER LICENSE AGREEMENT (EULA)

1. THE APPLICATION
Tastador ("Licensed Application") is a piece of software created to help users discover, rate, and review restaurants and dishes based on personalized food recommendations. It is customized for iOS and Android devices to provide users with a personalized feed of restaurant and dish recommendations based on their preferences and activity.
The Licensed Application is not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.), so if your interactions would be subject to such laws, you may not use this Licensed Application. You may not use the Licensed Application in a way that would violate the Gramm-Leach-Bliley Act (GLBA).
2. SCOPE OF LICENSE
You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Devices that you own or control and as permitted by the Usage Rules. This license will also govern any updates of the Licensed Application provided by Licensor.
You may not share, reverse engineer, translate, disassemble, decompile, copy, or alter the Licensed Application except as allowed by this license and Usage Rules. Violations may be subject to prosecution and damages.
The Licensor reserves the right to modify the terms and conditions of licensing. You must comply with applicable third-party terms and conditions.
3. TECHNICAL REQUIREMENTS
The Licensed Application requires firmware version 1.0.0 or higher. Licensor attempts to keep the Licensed Application updated, but you are responsible for ensuring your device meets the technical specifications.
Licensor reserves the right to modify technical specifications at any time.
4. MAINTENANCE AND SUPPORT
The Licensor is solely responsible for providing any maintenance and support services for this Licensed Application. You can reach the Licensor at the email address listed in the App Store or Play Store overview. The Services have no obligation to furnish any maintenance and support services.
5. USE OF DATA
Licensor may access and adjust your downloaded Licensed Application content and personal information subject to your legal agreements and Licensor's privacy policy at tastador.com/privacy.
Licensor may collect technical data and related information about your device and usage to improve products and services, in a form that does not personally identify you.
6. USER-GENERATED CONTRIBUTIONS
The Licensed Application may allow you to contribute content such as text, photos, and reviews ("Contributions"). Contributions may be viewable by other users and third parties. You represent and warrant that your Contributions do not infringe third-party rights, are not misleading or objectionable, and comply with all laws and this License Agreement.
Any violation may result in termination or suspension of your rights to use the Licensed Application.
7. CONTRIBUTION LICENSE
By posting Contributions, you grant Licensor an unrestricted, irrevocable, perpetual, non-exclusive, transferable, royalty-free license to use, copy, display, publish, and distribute such Contributions for any purpose in any media. You retain ownership of your Contributions, but waive all moral rights in them. Licensor has the right to edit, redact, recategorize, or delete any Contributions at any time.
8. LIABILITY
Licensor’s liability is limited to intent and gross negligence, except in case of essential contractual duties, injury to life, limb, or health. Licensor takes no responsibility for damages caused due to breach of license terms. You are responsible for backing up data and for any loss resulting from unauthorized modifications.
9. WARRANTY
Licensor warrants that the Licensed Application is free of malware at download and works as described. No warranty is provided for unauthorized modifications or usage outside Licensor's control. Defects must be reported within 30 days. Warranty obligations by Services Store Operator are limited to a refund of the purchase price.
10. PRODUCT CLAIMS
Tastador LLC, not the Services, is responsible for addressing any claims regarding the Licensed Application or your use thereof, including product liability, legal, or regulatory requirements, and claims arising under consumer protection or privacy legislation.
11. LEGAL COMPLIANCE
You represent and warrant that you are not located in a country subject to a US Government embargo, designated as a "terrorist supporting" country, or listed on any US Government prohibited or restricted parties list.

13. TERMINATION
This license is valid until terminated by either party. Upon termination, you must stop all use and destroy all copies of the Licensed Application.
14. THIRD-PARTY TERMS OF AGREEMENTS AND BENEFICIARY
Tastador LLC will comply with applicable third-party terms. Apple and Google are third-party beneficiaries of this EULA and may enforce its terms against you.
15. INTELLECTUAL PROPERTY RIGHTS
Tastador LLC is solely responsible for any third-party claim that the Licensed Application infringes intellectual property rights.
16. APPLICABLE LAW
This License Agreement is governed by the laws of the State of Florida, excluding its conflicts of law rules.
17. MISCELLANEOUS
If any term is invalid, the remaining provisions remain effective. Changes and amendments must be in writing. Users agree not to submit false reviews or manipulate the application’s recommendation engine. Licensor may remove suspicious content or suspend accounts at its sole discretion.
